By accessing or using Hourly, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.
2. Description of Service
Hourly is a time tracking application that allows users to:
- Track working hours and tasks
- Manage projects and clients
- Generate reports and analytics
- Export time tracking data
3. User Accounts
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
4. Acceptable Use
You agree NOT to:
- Use the service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Upload malicious code or harmful content
- Impersonate another person or entity
- Use the service to harass, abuse, or harm others
5. Intellectual Property
- Hourly and its original content, features, and functionality are owned by Indielabs
- Our trademarks and trade dress may not be used without prior written consent
- You retain ownership of data you input into the application
6. User Content
- You are solely responsible for the accuracy of time entries and data you submit
- We do not verify or validate the information you input
- You grant us a license to store and process your data to provide the service
7. Subscriptions and Payments
- Subscription fees are billed in advance on a recurring basis
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- You can manage or cancel subscriptions in your Apple ID Account Settings
- No refunds will be provided for unused portions of a subscription term
- By subscribing, you acknowledge that you have opted for the service voluntarily
- We reserve the right to modify pricing with reasonable notice
8. Service Availability
- We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
- We may perform scheduled maintenance with advance notice when possible
- We are not liable for any downtime or service interruptions
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDIELABS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Any damages exceeding the amount paid by you in the past 12 months
11. Indemnification
You agree to indemnify and hold harmless Indielabs from any claims, damages, or expenses arising from your use of the service or violation of these terms.
12. Termination
- You may terminate your account at any time
- We may suspend or terminate your access for violation of these terms
- Upon termination, your right to use the service ceases immediately
- You may request export of your data before termination
13. Modifications to Terms
- We reserve the right to modify these terms at any time
- Continued use after changes constitutes acceptance of new terms
- Material changes will be communicated via email or in-app notification
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these terms shall be resolved through:
- Good faith negotiation
- Mediation
- Binding arbitration (if negotiation fails)
16. Severability
If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
